1. Agreement to Terms
By accessing or using the Lorkon.ai website, mobile application, or any services provided by Lorkon AI, Inc. (“Lorkon,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use our services. These Terms constitute a legally binding agreement between you and Lorkon.
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of the services after such notification constitutes your acceptance of the modified Terms.
2. Description of Services
Lorkon provides two primary service categories:
LLC Protection Services (Solo, Builder, Operator plans): Automated scanning of state Secretary of State (SOS) filing databases, data broker site monitoring, dark web breach detection, automated data removal requests to data broker sites, SOS filing hijack monitoring, and periodic re-scanning for data re-listings.
Personal Data Removal Services (Shield, Fortress, Vanish plans): Phone number-based exposure scanning, data broker identification, automated removal requests to identified data broker sites, dark web breach monitoring, and periodic re-scanning.
Both services utilize automated AI agents to perform scanning, monitoring, and removal request functions on your behalf. These agents operate under the authority you grant us when you subscribe to a plan.
3. Nature of Removal Services — Important Limitations
Please read this section carefully. It describes fundamental limitations of our service.
Lorkon submits removal requests, opt-out forms, and data deletion demands to third-party data broker sites on your behalf. However, we cannot guarantee that any specific data broker will honor our removal requests or comply within any particular timeframe.
The following limitations apply to all Lorkon services:
- Third-party compliance is not guaranteed. Data brokers are independent third-party companies. While many are legally required to comply with removal requests under laws such as the California Consumer Privacy Act (CCPA), the California Delete Act, and similar state privacy laws, we have no control over whether or when they actually remove your data. Some brokers may take weeks or months to process requests. Some may not comply at all.
- Data re-listing is common. Data brokers routinely re-scrape public sources (state filings, court records, phone directories) and re-add previously removed data. This is why continuous monitoring and re-removal are core to our service. However, we cannot prevent re-listing from occurring.
- Not all brokers can be reached. Some data broker sites block automated opt-out requests, require manual identity verification (such as uploading a government ID), use CAPTCHA systems that prevent automated form submission, or have no opt-out mechanism at all. In such cases, we will make best efforts but cannot guarantee removal.
- Public records remain public. State LLC filings, court records, property records, and other government databases are public by law. Lorkon removes your data from third-party broker sites that aggregate and resell this information, but we cannot modify or remove the original public government records.
- Verification has limits. When we verify that your data has been removed from a broker site, we do so by searching for your name on that site. This method is not 100% accurate — brokers may store data internally even after removing the public listing, or our verification check may produce false positives or negatives.
- SOS monitoring depends on state systems. Our SOS filing hijack protection works by periodically checking your state’s Secretary of State website. If the state website is down, changes format, or delays publishing amendments, our monitoring may not detect changes immediately.
- Dark web data cannot be removed. We monitor dark web breach databases to alert you if your data appears. However, once data is leaked on the dark web, it cannot be removed or recalled. Our alerts help you take protective action (change passwords, freeze credit), but we cannot undo a breach.
- AI agent limitations. Our AI agents are sophisticated software programs, not human employees. They may encounter unexpected website changes, form layouts, CAPTCHA challenges, or API changes that temporarily prevent them from completing tasks. We continuously update our agents but cannot guarantee uninterrupted operation.
In summary: Lorkon will make commercially reasonable, good-faith efforts to remove your personal information from as many data broker sites as possible. We deploy advanced AI agents and proven legal frameworks (CCPA, state privacy laws) to maximize removal success. But because removal depends on the voluntary or legally compelled cooperation of hundreds of independent third-party companies, we cannot and do not guarantee specific removal outcomes, timelines, or completeness.
4. Subscription Plans and Billing
Lorkon offers monthly and annual subscription plans. All plans are billed in advance through Stripe, our payment processor. By subscribing, you authorize recurring charges to your payment method.
Free scan: The initial exposure scan is free and requires no payment or account. We collect your email address at the email gate to deliver your results and may use it to send you information about our paid services.
Plan features: Each plan tier includes different levels of service (number of LLCs covered, number of broker sites targeted, monitoring frequency, etc.) as described on our pricing page at the time of purchase. We reserve the right to modify plan features with 30 days’ notice.
Cancellation: You may cancel your subscription at any time through the Stripe Customer Portal (accessible from your dashboard or weekly email). Cancellation takes effect at the end of your current billing period. No partial refunds are issued for unused time within a billing period.
Refunds: We offer a full refund within 14 days of your first subscription payment if you are not satisfied with the service. After 14 days, no refunds will be issued. To request a refund, email support@lorkon.ai.
Failed payments: If a payment fails, we will attempt to charge your payment method again. If payment is not received within 7 days, your account will be marked as past due and removal/monitoring services may be paused until payment is resolved.
5. Your Responsibilities
- You must provide accurate information for your LLC name, state, phone number, and email address. Inaccurate information will result in ineffective scans and removals.
- You must have legal authority to request removal of the personal information you submit. You may only request removal of your own data or data for which you are an authorized agent.
- You are responsible for maintaining the security of your login credentials (magic link emails). Do not forward your login links to others.
- You must not use our services for any illegal purpose, to harass others, or to submit false information.
- You must not attempt to reverse-engineer, decompile, or otherwise extract the source code of our AI agents or proprietary scanning technology.
- You must not use automated tools to access our services in ways that exceed normal usage (API abuse, scraping our scan results, etc.).
6. Intellectual Property
All content, software, AI agents, algorithms, designs, and branding on Lorkon.ai are the intellectual property of Lorkon AI, Inc. You are granted a limited, non-exclusive, non-transferable license to use our services for your personal or business data protection purposes only.
You may not copy, modify, distribute, sell, or lease any part of our services or software. You may not use our brand name, logo, or service descriptions in your own marketing without written permission.
7. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
Without limiting the foregoing, we make no warranty that: (a) the services will meet your specific requirements; (b) the services will be uninterrupted, timely, secure, or error-free; (c) the results obtained from the services will be accurate or reliable; (d) any specific data broker will comply with our removal requests; or (e) any defects in the services will be corrected.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LORKON AI, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability for any claim arising from or relating to these Terms or our services shall not exceed the amount you paid to Lorkon in the twelve (12) months preceding the claim.
This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if Lorkon has been advised of the possibility of such damages.
Specifically, Lorkon is not liable for any damages resulting from: a data broker’s failure to remove your data; identity theft, fraud, or financial losses occurring despite our services; delays in removal processing; inaccuracies in scan results; SOS filing changes that our monitoring fails to detect; or data breaches of any kind.
9. Indemnification
You agree to indemnify, defend, and hold harmless Lorkon AI, Inc. and its officers, directors, employees, contractors, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of the services; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that your use of our services caused damage to a third party.
10. Dispute Resolution and Arbitration
Any dispute arising out of or relating to these Terms or our services shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Miami-Dade County, Florida, unless otherwise agreed.
YOU AND LORKON AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, both parties waive the right to a jury trial.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.
12. Termination
We may suspend or terminate your access to our services at any time, with or without cause, with or without notice. Grounds for termination include but are not limited to: violation of these Terms, fraudulent use of the services, abuse of our systems, non-payment, or any conduct that we determine, in our sole discretion, to be harmful to other users or to Lorkon.
Upon termination, your right to use the services will immediately cease. We may delete your account data, including scan results and removal history, after 90 days following termination.
13. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lorkon regarding the use of our services and supersede all prior agreements and understandings.
